Definition of an Alien

  • Any person who is not a national of the Republic of Korea
  • A corporation or group falling under any of the following subparagraphs:
    • A corporation or group founded in accordance with foreign laws;
    • A foreign corporation or group with foreign employees or members accounting for over 50%;
    • A foreign corporation or group with foreign employees or executives accounting for over 50%;
    • A corporation or group founded in accordance with Korean laws and over 50% of its capital or voting rights are held by foreigners or based on foreign laws, or its corporation or group

Land Acquisition Reported by Others

  • Target: If an alien has acquired land in the territory of the Republic of Korea
    ※ If an alien reports a real estate transaction, it is considered as the report of land acquisition.
  • Due date: Within 60 days from the date the contract of land acquisition is concluded (including bestowal, based on the date on which a contract is written)
  • Documents to be submitted: Land Acquisition Contract (a purchase agreement or a bestowal agreement), ID Card, and Real Estate Certificate for Aliens (Immigration Office)
    ※ If reported by the representative, the representative and the alien’s ID cards must be presented.
  • Fine: Not exceeding three million won

Land Acquisition by Means Other than a Contract

  • Target: When an alien has acquired land in the territory of the Republic of Korea by means of inheritance, auction, exercise of repurchase right, the court’s final ruling, or corporate merger
  • Documents to be submitted
    • Inheritance: Documents proving inheritance (Inheritee’s Basic Certificate and Certificate of Family Relations)
    • Auction: Written Decision of Auction
    • Court’s final ruling: Sentencing of Final Ruling
    • Repurchase: Documents proving repurchase (Repurchase Agreement, etc.)
    • Corporate Merger
  • Due date: Within six months after the date of land acquisition
  • Time required: Immediately
  • Fine: Not exceeding one million won

Report of Continuous Possession of Land

  • Target: In cases where a national of the Republic of Korea or an organization having land in territory of the Republic of Korea has become an alien and the alien intends to possess the land continuously
  • Due date: Within six months from the date of change
  • Documents to be submitted: Documents proving the change in nationality (a copy of Certificate of Naturalization) Individual: ID Card (a copy of passport)
    ※ If reported by a representative, a copy of the representative's ID card and the alien’s ID card must be submitted.
    • Corporation: Documents proving that a national or an organization of Korea has become an alien
  • Time required: Immediately (within three hours)
  • Fine: Not exceeding one million won
