  • Registration of Aliens – Article 31
    • If an alien intends to stay in the Republic of Korea for more than 90 days from the date of entry, the alien shall file for alien registration with the head of the Regional Immigration Office having jurisdiction over his/her place of stay within 90 days from the date of entry into the Republic of Korea.
      ※ In breach of the article, the alien shall be punished by imprisonment with labor for not more than one year or by a fine not exceeding 10 million won and may be deported in accordance with Article 95-7 of the Act.
  • Restrictions on Employment of Aliens (Prohibition of Illegal Employment) – Article 18
    • An alien without the status of stay that entitles him/her to engage in job-seeking activities shall not be engaged in any job-seeking activities. An alien having the status of stay shall not work at any place, other than the designated workplace.
    • e.g., Foreign investor’s spouse (F-3) teaching a language, the employer making an alien of non-professional employment (E-9) work at any place other than A which is the designated workplace, etc.
      ※ In breach of the article, the alien shall be punished by imprisonment with labor for not more than three years or by a fine not exceeding 20 million won and may be deported in accordance with Article 94-5 of the Act.
  • Permission to Extend Period of Stay – Article 25
    • Every alien who intends to continue to stay in excess of the permitted period of stay shall obtain permission to extend his/her period of stay from the Minister of Justice before the expiration of the permitted period of stay.
      ※ In breach of the article, the alien shall be punished by imprisonment with labor for not more than three years or by a fine not exceeding 20 million won and may be deported in accordance with Article 94-17 of the Act.
  • Permission to Change Status of Stay – Article 24
    • If an alien staying in the Republic of Korea intends to engage in any activity permitted under a status of stay not covered by his/her original status of stay, the alien shall obtain prior permission to change his/her original status of stay from the Minister of Justice.
    • e.g., International student’s (D-2) part-time job, language instructor’s (E-2) appearance on TV shows
      ※ In breach of of the article, the alien shall be punished by imprisonment with labor for not more than three years or by a fine not exceeding 20 million won and may be deported in accordance with Article 94-16 of the Act.
  • Changes and Addition of Workplace – Article 21
    • If an alien staying in the Republic of Korea intends to change or add his/her worklace within the scope of his/her status of stay, he/she shall obtain prior permssion from the Minister of Justice
    • e.g., If a professor (E-1) of College A wants to change his/her workplace to Collge B, if a foreign investor (D-8) wants to found a new business other than the regitered foreign investment company, etc.
    • Note: An alien with Non-professional Employment (E-9) Visa shall obtain final permission from the Minister of Justice before starting employment even though he/she has already obtained Employment Permission.
      ※ In breach of the article, the alien shall be punished by imprisonment with labor for not more than one year or by a fine not exceeding 10 million won and may be deported in accordance with Article 95-6 of the Act.
  • Granting Status of Stay – Article 23
  • An alien born in the Republic of Korea and staying without being granted the status of stay, and an alien staying without being granted the status of stay due to any other ground, such as loss or renunciation of the nationality of the Republic of Korea while staying in the Republic of Korea, shall obtain the status of stay respectively within 90 days from the date of his/her birth and within 30 days from the date on which such ground occurs.
  • e.g., If an alien gives a birth to a baby in Korea, If a Korean citizen loses his/her citizenship while staying in Korea due to the acquisition of another nationality, etc.
    ※ In breach of the article, the alien shall be punished by imprisonment with labor for not more than three years or by a fine not exceeding 20 million won and may be deported in accordance with Article 94-15 of the Act.
  • Reporting on Change in Place of Stay – Article 36
    • If an alien who has filed for registration  changes his/her place of stay, the alien shall file a moving-in report with the head of the Si/Gun/Gu (Gu includes a non-autonomous Gu; the same shall apply hereafter in this Article) or Eup/Myeon/Dong where the new place of stay is located, or with the head of the Regional Immigration Office having jurisdiction over the new place of stay within 14 days from the date of the move.
    • e.g., If an alien moves to Daebang-dong, Dongjak-gu, Seoul, he/she shall file a moving-in report with the Dongjak-gu Office or the Seoul Immigration Office. In case of a Korean citizen’s spouse (F-2-1), report within 14 days after his/her spouse’s report.
      ※ In breach of the article, the alien shall be punished by a fine not exceeding one million won in accordance with Article 98-2 of the Act.
  • Reporting on Changes in Matters Registered by Aliens – Article 35
    • An alien who has filed for registration shall report changes in registered matters to the head of the Regional Immigration Office having jurisdiction over his/her place of stay within 14 days: 1) His/Her name, gender, birth, and nationality;
      2) Number, date of issuance, and term of validity of his/her passport;
      3) Artist (D-1), Student (D-2), Industrial Trainee (D-4), and International Trade (D-9): Changes in his/her training institution or school (Including changes in name)
      4) Job Seeking (D-10): Changes in the status of training or his/her training institution (Including changes in name)
      6) Working Visit (H-2): Changes in the status of employment (within 14 days after the date of employment contract) or his/her workplace (Including changes in name)
      ※ In breach of the article, the alien shall be punished by a fine not exceeding two million won in accordance with Article 100-4. (1) of the Act.
  • Obligation to Report by Employers – Article 19
    • An employer of an alien granted status of stay that entitles the alien to engage in job-seeking activities shall report to the head of the competent Regional Immigration Office within 15 days of becoming aware of the circumstances if the alien is dismissed, resigned, or dead, his/her whereabouts become unknown, or the employer has amended the important terms of the employment contact with the alien.
      ※ In breach of the article, the employer shall be punished by a fine not exceeding two million won in accordance with Article 100-1 of the Act.
